Anthropology of law in the works of Musa Bigiev

Abstract
Anthropology of law became for Musa Bigiyev a pressing legal problem of human existence. It is generally accepted that traditionally one of the main tasks of legal anthropology is to substantiate the idea of law as a special normative order, based on the ideas about the essence of man, or human nature. M. Bigiyev, by studying the legal status of the individual, substantiated that in Islam, man has always been the main element of the mechanism of social development. However, after the «golden age of Islam», this feature was forgotten by Muslim rulers, Muslim scholars and the Muslim ummah as a whole. Musa Bigiyev pursued the goal of conveying this problem to Muslim society. The Tatar thinker saw the reason for the lag of the Islamic world behind Western civilizations in the decline of the legal status of the individual in Islamic states. The scientist emphasized the inadequacy of the development of human rights in Islamic law from a philosophical position and their implementation in practice. Therefore, through all his ideas runs a thin thread of analysis of the definition of the place of man in Islamic law and Islamic law in man.
